Heritage Rail Bikes’s websites (the “Service”) are operated by (“us”, “we”, or “our”). All headers used herein are provided for the convenience of ease of reference purposes only.

Your access to and use of the Service is conditioned on your unconditional acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. If you do not agree with these terms and conditions, exit the website immediately without purchasing any service or item from our website.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Purchases

If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your email address, full legal name, address, credit card information, phone number(s), names of participants (potentially including those under the age of 13), and other identifying information which may be used by Heritage Rail Bikes or our affiliates for fulfilment and/or marketing purposes. Aside from any credit card information, you may provide during checkout, you hereby grant use of all other information you may provide for the purposes of marketing and promotion as Heritage Rail Bikes deems fit.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Our Service includes custom graphics, photos, logos, trademarks both registered and claimed under common law, copyright text, and other information which, if misused, can result in legal action taken against any third party. To obtain permission to reuse or distribute content made available on this website or any of Heritage Rail Bikes other websites, you must first contact Heritage Rail Bikes marketing department, which can be reached at info@heritagerailbikes.com.

Heritage Rail Bikes has the right to obtain injunctive relief to prevent any unauthorized use of Heritage Rail Bikes’s intellectual property or websites. Furthermore, Heritage Rail Bikes does not have any obligation to grant use of intellectual property or information on this website or any other owned by Heritage Rail Bikes. Should you make a request for permission to use our content, you may not use our content until given explicit written instructions from Heritage Rail Bikes authorizing its intended use.

Online Purchasing

Heritage Rail Bikes holds the exclusive rights to sell any merchandise or tickets related to Heritage Rail Bikes or any brands associated with Heritage Rail Bikes. We explicitly encourage visitors to not seek tickets or merchandise through any third party provider or online patron claiming they have tickets available for sale as they are almost certain to be fraudulent in nature. ONLY TICKETS PURCHASED THROUGH OUR SITE ARE AUTHENTIC. Heritage Rail Bikes WILL NOT HONOR TICKETS PURCHASED OR TRANSFERRED THROUGH A THIRD PARTY. 

Reported Suspected Fraud

If you see someone online (especially on social media websites) claiming to have tickets for sale, please report them to Facebook as they could be taking advantage of unsuspecting users and defrauding people with false tickets. If you are a victim of one of these fraudulent ticket resellers, we strongly encourage you to contact your local police authority to report the occurrence.

Our Service may contain links to third-party websites or services that are not owned or controlled by Heritage Rail Bikes.
Heritage Rail Bikes has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Heritage Rail Bikes shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time, without any notice. Any changes will be published here for immediate effect unless otherwise noted herein.

REFUND POLICY

You may cancel your ride anytime up to 72 hours in advance by emailing us at info@heritagerailbikes.com. Your ride may be rescheduled up to 24 hours in advance. We operate rain or shine, but will cancel in the event of thunder and lightning or other unsafe conditions. If we cancel, you will be entitled to a full refund to your original payment method.  
Each ticket holder is expected to arrive at the meeting point at their designated time. Early or Late arrivals may result in denied entry. Early arrivals may be asked to wait until their designated time. A refund will not be issued if a ticket holder is late. If a ticket holder does not show up during their designated time, they forfeit their ticket without the possibility of refund or credit.

Unless otherwise stated, Heritage Rail Bikes will go on rain or shine. All ticket holders are expected to arrive at their designated time regardless of weather. In the case of extraordinary weather, the activity may be postponed by Heritage Rail Bikes; please check the website for updates. If the activity is postponed by Heritage Rail Bikes, the ticket holder will be given the option to come any other day for the remainder of the current calendar year. The ticket holder does not have the right to make a judgment about what warrants a closure due to weather for the purposes of demanding a weather related refund. In the event of a technical failure requiring the activity to be delayed or cancelled for the evening, guests will similarly be invited to return any other day the show is open for the remainder of that current calendar year.

Heritage Rail Bikes reserves the right to cancel any tickets or remove any ticket holder for any reason without refund.
